Within homeowners’ association insurance policies, legal defence is a fundamental cover that legally protects the community against disputes or claims. This guarantee makes it possible to face legal expenses and receive specialist legal assistance without the community having to bear the full cost of the process.
Telephone Legal Advice or Defence with Legal Representation
When referring to this type of guarantee or cover, some policies describe it as legal advice, while others refer to legal defence. It is worth clarifying both concepts. Telephone legal advice is an immediate legal consultation service for questions about horizontal property law, contracts, problems with neighbours and similar matters. Legal defence with legal representation, on the other hand, refers to cover for the intervention of lawyers, court representatives and experts, either to bring a claim or to defend the community against lawsuits or complaints.
What Does Legal Defence Cover in Homeowners’ Associations?
We always say this when explaining any community insurance cover, and this guarantee is no exception. There can be very significant differences between what one insurer includes and what another includes. Some companies even offer a basic version and an extended version of legal defence.
In any case, these are the usual guarantees included in the legal defence section of most community insurance policies:
- Lawyers’ fees, whether freely chosen or appointed by the insurer.
- Court costs: fees, court representatives, expert reports and notifications.
- Claims for damage suffered by the community.
- Criminal defence, if the community or governing board is reported, although not all insurers include this.
- Out-of-court assistance, including negotiations or steps before proceedings.
- In some cases, drafting and reviewing legal documents such as supplier contracts or community agreements, depending on the policy.
When Can It Be Used?
This cover is especially useful in cases such as claims for unpaid community fees from residents, as well as disputes about noise, building works or misuse of common areas. It also applies when the community needs to defend itself against claims from third parties.
It can also be activated in contractual disputes with service providers, such as cleaning or maintenance companies, or in conflicts with other communities or with the insurer due to disagreements over claim coverage.
Limits and Exclusions
If you read each insurer’s general conditions carefully, you will see that they usually set a limit on covered legal expenses. In some cases this may be up to EUR 3,000 per claim. In other cases, the general conditions will state: insured sum according to particular conditions.
As for common exclusions, these usually include disputes that arose before the policy was taken out. The same often applies to cases of bad faith or intentional negligence, as well as fines or penalties imposed by courts.
Can the Community Choose Its Own Lawyer?
Yes, although it depends on the insurer. Some allow free choice of lawyer, subject to a reimbursement limit. Others require the use of their collaborating legal network. Our advice is to check whether your policy allows free choice and what maximum amount is covered.
Having this cover is not a luxury; it is a necessity. Legal conflicts in communities are not rare, and legal defence can save thousands of euros and many headaches.
