Today we are looking at loss of rent cover in community insurance policies. This is a cover that is often linked to uninhabitability cover.
Loss of rent cover is included in some community insurance policies and protects the owner against the financial loss caused by being unable to rent out a property affected by a claim. This guarantee is especially relevant when properties become uninhabitable due to material damage, such as fires, floods or similar insured events.
How Insurers Define Loss of Rent
Insurers usually agree that this guarantee covers the amount of rent that the owner stops receiving due to the property becoming uninhabitable as a result of a claim covered by the policy. However, there are nuances in how each company defines and applies the cover.
Some insurers define loss of rent as the actual financial loss suffered by the owner due to termination of the lease following a claim that makes the property uninhabitable. Other companies focus on covering rent not received during the time needed to repair the damage, provided that the property was rented at the time of the claim. In other cases, loss of rent is linked to the period during which the property remains forcibly vacated as a consequence of a claim. Some policies specify that reasonable rental expenses for uninhabitable properties are guaranteed, including specific limits per claim and per year.
It should be noted that not all insurers include this guarantee, but major insurers we work with, such as Allianz, Caser, Ocaso, Mutua de Propietarios, Zurich and Reale, often include this cover. Each insurer defines and includes it differently in its policy, although the general approach is usually similar. It is therefore essential to review the limits or insured sums in the particular and/or general conditions.
What Loss of Rent Cover Includes
Although, as explained above, inclusions vary between insurers, it generally covers:
Rent not received during the period of uninhabitability of the property caused by material damage covered by the policy.
Differences Between Insurers
Each insurer introduces specific nuances that affect the scope of cover:
- Insured limits: Some companies set a limit of 15% of the insured capital for the building, while others set a maximum of EUR 300,000 per claim.
- Maximum duration of cover: Most insurers limit cover to 12 months.
Additional Considerations
It is logical that uninhabitability cover cannot be applied at the same time as loss of rent cover for the same dwelling. It is also important to remember that, for this cover to apply, the claim that caused the uninhabitability must be covered by the guarantees included in the policy.
