Today we are looking at a type of claim that is unfortunately quite common in home insurance policies. We are referring to whether a home insurance policy covers theft away from home.

Difference Between Theft, Robbery and Mugging in Spain

In Spain, theft, robbery and mugging are different legal concepts.

Theft

Theft refers to the taking of someone else’s property without violence or intimidation. For example, if someone takes a person’s bag in a park without using force and without intimidation, it would be considered theft.

Robbery

Robbery refers to the taking of someone else’s property using violence or intimidation in an enclosed or lockable place. For example, if someone enters a house and takes a television, it would be considered robbery.

In short, the main difference between theft and robbery lies in the place where the offence is committed and the violence or intimidation used. Robbery is usually considered a more serious offence than theft and is therefore normally associated with more severe penalties.

Mugging

Mugging is the taking of property through violence or intimidation in a public place or a place open to the public. In other words, it is an offence committed in places such as a street, park, transport station or bank.

Therefore, mugging is different from robbery. Although they share similar characteristics, mugging refers to a taking that occurs in a public place or a place open to the public, while robbery refers to taking property with violence or intimidation in an enclosed place.

Does Home Insurance Cover Theft?

The scope of home insurance cover varies depending on the insurer and the guarantees taken out. In general, home insurance covers robbery of personal belongings inside the home, and in some cases it also covers the theft of personal belongings away from the home.

Some insurers added theft away from the home many years ago, subject to certain limits. Other insurers have still not incorporated it.
